The area of attack most people are familiar with is search and seizure.  Almost all cases involving drugs begin with some sort of search and seizure. As a defense attorney, it is my job to look for those errors that law enforcement officers made that could result in the evidence being suppressed or kept out of evidence. If all the drugs and other evidence found are kept out of evidence, then the case is thrown out, because there is no evidence for the state to use against you at trial.

Search and seizure is very fact specific. Two cases that look exactly the same on the surface can be ruled on differently depending on the testimony at a suppression hearing. The differences in the specific facts can be very small, but can mean the difference between conviction and dismissal. This applies in cases involving simple possession for personal use to manufacturing and selling drugs.

Tennessee Officers are trained how to do searches legally. Officers are also like everyone else in that they don’t remember everything the have been told.  Search and seizure is a complex area of law for lawyers and judges, and can be even more so for the officer on the street. They make mistakes. With those mistakes comes the opportunity to win the case.

Drug abuse is also a problem that affects other area of law. People with drug problems get divorced, lose their children, homes and property, and get arrested for property crimes and crimes of violence. Some people steal to feed their habits. This can be done by shoplifting and burglaries, to aggravated robberies. An option there is treatment.

The District Attorney’s Office, law enforcement, and the courts want someone clean and a productive citizen more than they want someone locked up.  Attending a treatment program, and completing it, can make all of the difference in the outcome of a case. It is easy for most people to choose 28 days in an inpatient facility versus four years in a jail cell.

Some sellers are also drug abusers. The selling is a natural extension of a need to feed their habit. Treatment options can work for these people too.
