How To Win Your Criminal Case.

Step One: In order to win your case, you have to figure out what is winning. Getting the charges dismissed would be winning for everyone. Not going to jail might be winning for someone else.  The first step to winning is getting the right attorney to help you.  The next thing is doing what your attorney says to do in order to win your case.

Step Two: Gather as much information as possible.
There may be several things available to you prior to you matter going to court such as incident reports, witness and victims statements, and other important documents and recordings. Information is power. With information, you can look at the strengths and weaknesses in the government’s case.

Step Three: Develop a plan of action.
Every case is unique.  Every person is unique. As a result, what works in one case might not work in another. There are things to do prior to settlement date or trial. Once we have as much information that we can gather, we can develop that plan. The plan is affected by the nature of the charge or charges, the background and the history of the defendant, and the outcome goal you have. Don’t forget Plan B, just in case Plan A doesn’t survive first contact.

Step Four: Put the plan into action.
What happens during the execution of the plan can make all the difference. Failure to follow the plan can destroy your defense. Following it is no guarantee of success either. Doing nothing, however, leaves you completely at the mercy of the government and your accusers.

Step Five: Be flexible.
You have to be flexible. Things change that are not foreseen. Witnesses lie.  Officers get injured. Your witnesses don’t show, or change their stories. Get ready for anything and to move with the flow. It is frustrating, but it is how it is.

Step Six: Be patient.
This step might as well be step one or two. Just because you want everything done now and over with doesn’t mean that the judge or the state is as anxious as you are. These things will get resolved.  Your life is on hold when charged, and we understand that. Failure to exercise patience can cause you to make bad decisions which make things worse on you than they may have already been.
